These Terms of Service ("Terms") govern your access to and use of the websites, content, products, services, memberships, accounts, and related features offered through Futstrikers® Club on the futstrikersclub.com domain and related pages (collectively, the "Services").

Futstrikers Sports LLC operates Futstrikers® Club. Futstrikers, Inc. is the parent company and owner of the Futstrikers® brand. In these Terms, "we," "us," and "our" refer to Futstrikers Sports LLC and Futstrikers, Inc., as applicable.

By accessing or using the Services, creating an account, purchasing products, joining Futstrikers® Club, or otherwise interacting with the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services, create an account, join Futstrikers® Club, or make a purchase. By using the Services, you represent and warrant that you meet these requirements.

2. Scope of Services

The Services may include, without limitation:

Retail sales of match balls, legacy balls, team or club balls, accessories, memberships, and related products;
Customer accounts and gated account experiences;
Futstrikers® Club membership benefits and member-only content;
Promotions, blog content, marketing content, and social content;
Special pricing programs, team code programs, and approved account payment options;
Wholesale-related features or access made available to approved accounts.

We currently sell and ship retail orders within the United States only. We may expand availability in the future in our sole discretion.

3. Additional Policies

Your use of the Services is also subject to our other policies, which are incorporated into these Terms by reference, including our:

Privacy Policy;
Cookie Policy;
Return & Refund Policy;
Shipping Policy; and
Any other posted policies, guidelines, or program-specific terms.

If you are an approved wholesale account or otherwise subject to separate account, pricing, reseller, or payment terms, those separate terms also apply and will control in the event of a conflict with these Terms as to that subject matter.

4. Account Registration and Security

You may be required to create an account to access certain features of the Services, including Futstrikers® Club membership benefits. You agree to provide accurate, current, and complete information and to keep your information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us if you believe your account has been accessed without authorization.

We reserve the right to suspend or terminate any account that we believe is inaccurate, misleading, fraudulent, abusive, or otherwise in violation of these Terms.

5. Orders and Order Acceptance

All orders are subject to review, acceptance, and availability. We reserve the right, in our sole discretion, to refuse, limit, cancel, or reject any order for any lawful reason, including due to:

Product availability or inventory limitations;
Pricing, listing, or typographical errors;
Suspected fraud, abuse, misuse, or unauthorized activity;
Improper use of member pricing, club codes, or special pricing access;
Suspected unauthorized resale activity;
Payment processing issues; or
Other operational, legal, or compliance reasons.

If we cancel an order after payment is submitted, we may issue an appropriate refund to the original payment method unless otherwise stated.

6. Product Information, Availability, and Pricing

We try to present product information accurately, but we do not warrant that product descriptions, pricing, inventory status, colors, images, specifications, availability, or other content on the Services are error-free, complete, current, or accurate.

Colors and appearance may vary based on your device, monitor, browser, and lighting conditions. Product availability may change without notice.

We reserve the right to correct errors, update listings, modify or discontinue products, adjust pricing, and cancel affected orders at any time, including after an order is submitted.

7. Payment

You agree to provide current, complete, and accurate billing and payment information for all purchases. By submitting payment information, you represent and warrant that you are authorized to use the selected payment method.

We may use third-party payment processors and ecommerce infrastructure providers to process transactions. Your use of those services may also be subject to their terms and policies.

8. Futstrikers® Club Membership

Futstrikers® Club is an annual membership program currently offered at $19.99 per year, unless otherwise stated at the time of purchase. Membership pricing, features, eligibility rules, and benefits may change prospectively at any time in our sole discretion.

By purchasing Futstrikers® Club, you agree that:

You must purchase the membership first in order to create or activate your member profile;
You must generally log in to your member account to access member pricing, gated content, and related member benefits;
Membership renews annually until cancelled;
Unless otherwise required by law or expressly stated by us, membership fees are non-refundable once charged;
If you cancel, your cancellation will apply to the next renewal period unless otherwise stated at the time of cancellation;
We may change, suspend, limit, or discontinue membership benefits prospectively at any time.

Current member benefits may include, where applicable and as offered at the time of purchase:

25% off eligible in-line match ball purchases sold at MSRP;
Access to eligible markdown pricing where offered;
Free shipping on eligible ball orders shipped within the United States, excluding Alaska and Hawaii;
Access to member-only content and related member experiences.

Membership benefits do not apply to all products. Unless we expressly state otherwise:

Team balls are excluded from Futstrikers® Club member discounts and are sold separately through valid team or club code pricing;
Accessories are excluded from Futstrikers® Club member discounts and benefits;
Discounts do not stack with unauthorized offers, codes, or pricing methods.

We reserve the right to suspend, revoke, or terminate membership access if we suspect misuse, abuse, account sharing, code abuse, pricing abuse, fraud, or violation of these Terms.

9. Team Balls, Club Codes, and Special Pricing

Certain products, including team balls, custom balls, or club-specific balls, may be offered only through special pricing programs, club pricing, or valid team codes. Team or club pricing is subject to the rules of the applicable program and may not be combined with Futstrikers® Club membership discounts unless we expressly state otherwise.

Orders for team balls, custom balls, or club-specific products may be subject to special conditions, including limited availability, code validation, and final sale treatment, except as expressly provided in our Return & Refund Policy or as required by law.

10. Approved Account Payment Terms

Certain payment methods or payment terms may be available only to eligible approved accounts. Availability of such a payment method on the Services does not grant eligibility or approval.

Orders placed using approved account payment terms are subject to review, confirmation, and any separate agreements previously entered into with us. Such orders are not automatically accepted, processed, or fulfilled solely because they are submitted through checkout.

11. Shipping and Delivery

We aim to fulfill orders within approximately 48 hours during business hours, Monday through Friday, 9:00 a.m. to 2:00 p.m., excluding holidays and subject to operational conditions. These timelines are estimates only and are not guaranteed.

We primarily use third-party carriers, including UPS, for shipment. Once an order is transferred to the carrier, transit times, shipping delays, delivery exceptions, and other carrier-related issues are outside our direct control.

You are responsible for providing an accurate shipping address and complete delivery information. We are not responsible for delays, failed deliveries, or additional costs arising from inaccurate or incomplete shipping information provided by you.

Shipping fees, eligibility, methods, restrictions, and timelines may be further described in our Shipping Policy or at checkout.

12. Returns, Refunds, and Cancellations

Our Return & Refund Policy governs returns, replacements, refunds, damage claims, membership refunds, and related matters. By making a purchase, you agree to that policy.

Without limiting the foregoing:

Orders may not be cancellable once submitted, processed, or prepared for shipment;
Membership fees are generally non-refundable except as required by law or expressly stated by us;
Custom, team, club-specific, and other special-order products may be final sale except as required by law or expressly stated in our policies.

13. Acceptable Use and Prohibited Conduct

You agree not to:

Use the Services for any unlawful, fraudulent, deceptive, or abusive purpose;
Use another person’s account without authorization;
Share, transfer, resell, or misuse membership benefits, member pricing, club codes, or special pricing access;
Attempt to obtain unauthorized access to non-public portions of the Services or related systems;
Interfere with the operation, security, or integrity of the Services;
Scrape, copy, harvest, or extract data, content, pricing, or images from the Services without our prior written permission;
Use the Services or products for unauthorized commercial resale or distribution;
Upload, transmit, or submit harmful code, malware, spam, or unlawful content;
Misrepresent your identity, affiliation, eligibility, or authority.

We may suspend or terminate access to the Services or your account if we believe you have violated these Terms.

14. Intellectual Property

The Services, and all content and materials available through them, including without limitation text, graphics, logos, product names, trademarks, service marks, trade dress, photographs, images, videos, designs, software, layout, and other materials, are owned by or licensed to us and are protected by intellectual property and other applicable laws.

Futstrikers®, Futstrikers® Club, and related branding are proprietary to us or our affiliates. You may not use, reproduce, distribute, modify, display, publish, create derivative works from, or exploit our content or branding without our prior written permission.

15. Reviews, Feedback, and User Content

If you submit or post reviews, comments, testimonials, photos, videos, feedback, suggestions, tagged social content, or other content to or about the Services ("User Content"), you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, distribute, adapt, edit, translate, create derivative works from, and otherwise exploit that User Content in connection with our business, marketing, and Services.

You represent and warrant that:

You own or control the necessary rights to the User Content you submit;
Your User Content is accurate and not misleading;
Your User Content does not violate any law or third-party rights;
Your User Content is not defamatory, obscene, infringing, fraudulent, or otherwise unlawful.

We reserve the right, but not the obligation, to remove, edit, refuse, or moderate User Content in our sole discretion.

16. Third-Party Services and Links

The Services may include links to or integrations with third-party websites, platforms, processors, shipping carriers, social media services, embedded content, and applications. We do not control and are not responsible for third-party services, content, policies, or practices. Your interactions with third parties are governed by their own terms and policies.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, PRODUCTS, CONTENT, MEMBERSHIPS, AND ALL RELATED MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT PRODUCTS OR CONTENT WILL ALWAYS BE AVAILABLE.

Nothing in these Terms is intended to exclude or limit any warranty or right that cannot be excluded or limited under applicable law.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FUTSTRIKERS SPORTS LLC, FUTSTRIKERS, INC., OR THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OWNERS, AGENTS, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SERVICES, PRODUCTS, MEMBERSHIPS, OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US FOR THE APPLICABLE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you to the extent prohibited by law.

19. Indemnification

You agree to defend, indemnify, and hold harmless Futstrikers Sports LLC, Futstrikers, Inc., and their respective affiliates, officers, directors, employees, owners, agents, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

Your violation of these Terms;
Your misuse of the Services, membership benefits, or special pricing access;
Your User Content;
Your violation of any law or any third-party right.

20. Governing Law and Venue

These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms or the Services, are governed by the laws of the State of Arizona, without regard to its conflict of laws principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction and venue of those courts.

21. Electronic Communications

By using the Services, creating an account, or communicating with us electronically, you consent to receive communications from us electronically, including by email, through your account, by SMS where you have opted in, or by postings on the Services, to the extent permitted by law.

22. Force Majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including without limitation acts of God, weather events, fire, flood, labor disputes, carrier delays, supply chain disruptions, pandemics, epidemics, war, terrorism, civil unrest, governmental actions, utility failures, internet or telecommunications failures, technology outages, or other force majeure events.

23. Changes to These Terms

We may update or modify these Terms at any time in our sole discretion. When we do, we will post the updated version and revise the "Last updated" date above. Changes will be effective upon posting unless otherwise stated.

Your continued use of the Services after updated Terms are posted constitutes your acceptance of the revised Terms to the extent permitted by law. If you do not agree to the revised Terms, you must stop using the Services.

24. Termination

We may suspend or terminate your access to the Services, your account, your membership, or your ability to purchase from us at any time, with or without notice, if we believe you have violated these Terms, misused the Services, engaged in fraud or abuse, or otherwise created risk or liability for us or others.

Any provisions of these Terms that by their nature should survive termination will survive, including without limitation provisions relating to ownership, payment obligations, disclaimers, limitations of liability, indemnification, governing law, venue, and dispute-related terms.

25. Severability; No Waiver; Assignment; Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision or any other provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms and our rights or obligations under them at any time.

These Terms, together with the policies and other documents incorporated by reference, constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous understandings relating to the subject matter hereof, except for any separate written agreement between you and us that expressly governs a specific program or account.
